On January 17, US President Joe Biden was delayed by ratification-in 2018-on the 28th amendment (“Equal Rights Amendment”) of the US Constitution.
On January 20, future President Donald Trump issued an enforcement order stating that the 14th amendment (and 8 USC 1401) no longer means what they always meant and always understood that they mean where this constitutional amendment And this decree of the Federal Law that all persons “born in the United States and subordinate to their jurisdiction” are US citizens.
Although it is refreshing to see a president acknowledge the rule of law regarding constitutional amendments, even inefficient and late date, it seems much more likely to reject this law by Trump and his claim that he has unilaterally canceled the 14th Amendment will prove the more effective political move, at least in the near future.
Not because Trump is right, but Biden is wrong, keep in mind (in this case it is the opposite), but because the US Constitution is respected or neglected depending on whether the government prefer to respect or ignore it.
They respect it when it allows them to do whatever they want, or at least it does not interfere with what they want to do, especially when a big show of respect is done, which leads to a good PR.
They neglect it whenever it says they can’t have something they want, and then they hope the courts are also ready to ignore it.
That takes me to my favorite quote from Lisander Popner (regular readers of my column will recognize it): =
“But whether the Constitution is really one thing or another, it is certain – that it either allowed such a government as we had or was powerless to prevent it. In both cases it is unfit to exist. “
The dependence on the Constitution protects us from the US government as a whole or on the president in particular a stupid game.
It is as if you are waving the title of your Audi in the face of a thief, believing that he will pick up his gun and leave you alone as he sees it.
If Trump continues with his anti -immigration nonsense (which, aside, aside the “nationality citizenship”, is a constitutionally prohibited in its entirety by Article I, Section 9 and amendment 10), the appeal of the Constitution will not help.
If we want to protect this particular element of freedom, it will require our active physical resistance.
