Green Card Durham holder detained by ICE is to deport drug fees – WRAL NEWS

A Durham man in the United States on a green card is already in an immigration facility in Georgia after the ice agents detained him last week.

Heather Spink said her husband Zariab Hassan had had legal status in the United States since 2003. In 2022, he was confronted with charges of crimes, including the sale of heroin and death by distribution.

Wral News found in court records that Hassan has accepted a legal basis agreement that includes a test sentence of 2023-2026.

Last Wednesday, Hassan entered a meeting with his probation officer.

“As soon as it enters, the probation officer took him to a conference room and there were four ice [officers] There they instantly said, “Put your hands behind your back,” Spink said.

Hassan was taken to an immigration facility in Carrie, then Alamans County, until he landed at a Georgia facility nearly 24 hours later.

“This is the worst thing I have ever had to experience and there is nothing I can do,” said Spink.

Ice arrests of probation meetings for green card holders are not new. Chapel Hill Yenia Polanco-Galdamez’s lawyer said they could occur in circumstances of a breach of probation or the main accusations, although we may see such arrests more often.

“I think there is an increased level of performance,” she said. “There is a very clear message from this administration that they will hold and remove as many people as possible.”

Green card holders are subject to deportation if they are convicted of a crime considered to be a deportable crime. This includes violent attacks, drugs related to drugs and certain financial crimes.

Polanco-Galdamez said that green card holders have fewer negotiations for an agreement on legal basis, as they are treated differently by an American citizen under the federal law due to the security of the effects of potential deportation.

“What is happening is that the individual may not really evaluate or understand their request and they agree or accept an agreement on a legal basis, where they are found guilty – or perhaps a deferred prosecution – for a basic crime, Which makes them deportable, “she said.

Wral News searched the court records and found Hassan faced with additional charges of crimes in 2024. It is unclear which accusations ultimately led to ice arrest, but both the charges of crime in 2022 and the violation of probation may be grounds for deportation.

Chapel Hill Immigration Lawyer Chris Barnes said Ice does not always take a person in custody immediately after committing a crime.

“This person is possible, this individual, has recently been marked and became on the Ice radar, [or] This can be an increase in ice application, “he said.

Spink watches what this means to her husband, who is now stated.

“Nobody knows, [and] No one talks about it. So, we’re here, ”said Spink.

Barnes said deportable crimes include violent attacks, certain drugs and certain financial crimes crimes.

What do lawyers recommend to make green card holders?

Polanco-Galdamez recommends that residents of residents apply for citizenship in order to be granted additional protection and powers.

Not every person who has a green card is eligible for citizenship. In order to qualify, one must have five years of good moral character. As a result, certain crimes would make a person unacceptable.

Immigration attorneys advise persons to consult experts or their criminal protection lawyer so that they are aware of their rights and consequences with which they are confronted if they have been convicted of a crime or they conclude a legal basis. Green card holders have less negotiations on legal basis, as they are treated differently by a US citizen under the Federal Law because of the security of potential deportation.

Barnes says that if you have committed a deportable crime and are placed in the removal proceedings, there are certain opportunities that exist in the immigration court. You can request an immigration bond or stay detained and apply for relief through immigration courts as a person in custody.
