Fremonth, California (KGO) – A controversial plan for banning homeless camps is considered in Fremonth.

For years, Rigberto Robbles lived on this camp of Bart songs from Washington Boulevard.

Robbles now lives with his brother in Concord. He kept his dog Lucille.

“Because it gets cold and I’m worried about her, yes, she’s my baby,” Rolls said.

On Tuesday, members of the Fremont City Council will vote an ordinance that will make illegal camps in most public properties, including sidewalks and parks.

Violations would mean a fine of $ 1,000 or a prison for six months.

According to Asylima member, Alex Lee says this proposed plan goes a step too far.

“I cannot say for sure that I know all the municipal codes of every city of how they dictate the language, but I can tell you about the fact that this ordinance, the way it is written literally criminals sleeping out,” a member of the Assembly, “said Lee.

The ordinance also contains a clause that prohibits the “support” or “promoting” of a homeless camp.

VIVIAN WAN is CEO of Abode Services, a homeless and residential services agency, which works in eight counties in the Bay area.

“I said you need railings. We will never support a ban because they don’t work, but this is the most compliant, the most striking ban we have seen in what the police are giving full power,” Wan said.

Last week, the Fremont Police Association released a statement expressed in support.

Saying in part, “This is just an instrument that must be used in limited circumstances when members of non -existent communities refuse to comply with the requests and reject the aid.”

Fremont Mayor Raj Salvan said their intention was not to arrest homeless people or non -profit workers.

“In principle, this gives us the execution authority,” Salvan said.

Salvan said that the “support” and “adherence” clause was misunderstood.

“You want to help them somehow provide services, then in any way we would like to get your help; however, if you build structures such as trees or waterways or in parks, they are not safe,” Salvan said.

On Tuesday, Salvan stated that the members of the Municipal Council will have a second reading of this proposed ordinance and may clarify the concerns with the Community.

“Our city lawyer has prepared the ordinance based on other regulations. So it is based on, for example, on California with Gavin New York, Berkli, Hayward has this ordinance,” Salvan said.

The assembly member Lee said that if the arrests were not the intention, the ordinance should indicate that.

“This raises the good question, as if this is not the intention, if the police do not want to do so, the members of the city councils do not want to do it – why should he be given the expressed authority to do it?” said Lee.
