Washington, DC
— Sen. Tom Cotton (R-Arkansas) today wrote a letter to Attorney General Merrick Garland urging the Department of Justice to withdraw its threatening letter to Elon Musk’s PAC for America. The letter describes a pattern by the Biden-Harris Justice Department that singles out conservative groups while turning a blind eye to left-wing groups engaged in similar behavior.
In part, writes Senator Cotton:
“Left-wing organizations often promote voter registration sweepstakes. For example, HeadCount Inc. offers potential voters a chance to “win a RuPaul’s Drag Race VIP experience” for checking their voter registration status or starting the voter registration process. Michelle Obama’s voter registration group offered people who submitted their registration information a chance to win a free trip to Las Vegas. These leftist groups are just as surely trying to register potential voters with their sweepstakes as America PAC.”

Dear Attorney General Garland,
I’m writing about reports that the Justice Department has warned Elon Musk’s America PAC that its sweepstakes may violate federal law. I am not convinced that America PAC broke the law, but I am very concerned that the Biden-Harris administration has once again chosen center-right Americans like Mr. Musk for political retribution while turning a blind eye to liberal-leaning groups engaged in similar behavior .
Left-wing organizations often promote voter registration sweepstakes. These leftist groups are just as surely trying to register potential voters with their sweepstakes as America PAC.
But where are the threats of legal consequences for liberals? Have you sent Michelle Obama an embarrassing letter? I think the question answers itself, of course, and demonstrates once again how you have weaponized the Department of Justice not only against President Trump, but also against his supporters.
I urge you to withdraw the department’s letter as an ill-conceived case of partisan murder. Thank you for your prompt attention to this important matter.
Sincerely,
Tom Cotton
United States Senator
