A man accused of decades of murder of Moristown

A 71-year-old man accused of fatally shot his wife more than 30 years ago in Morisville died last week.

Carol Peters of Hyde Park was accused by a large jury in September on a first -degree murder accusation and was released from a $ 200,000 warranty prison while the case was waiting. Police say Peters shot and killed his wife Cheryl Peters in 1993.

Peters died early Thursday morning from respiratory failure due to pneumonia, according to his death certificate.

Cases are usually rejected when the defendant dies, which can lead to sealed or discarded accusations of a person’s record.

But the lawyer of the Lamoy County County Aliena Gerhard said he plans to file a proposal to prevent the accusation of murder from the recording of Peters.

“We are disappointed that we will not be able to bring this murder of court, but we hope that the prosecution brought at least some measure of comfort to the Cheryl Peters family,” Gerhard said in a written statement. “They waited thirty years for justice for their mother’s brutal murder.”

The judges decided not to capture accusations of such situations, like in 2022, when an 80-year-old has been charged with a sexual assault case for decades before he went to court. The judge in this case ruled that it was in the “interest of justice” to maintain open records.

Peters has encountered investigations over the years about his alleged role in the death of his wife. During this time, he continued to live and work in the Morisville area.

The accusation of first -degree murder came after Gerhard emphasized a large jury, a process that was rarely used in Vermont state courts to examine the case. At a major hearing, the prosecutor presents evidence to a group of people who then vote on whether there is sufficient evidence to blame someone.

Gerhard told reporters in September that she had not revealed new evidence in the case when he had led him to the big jury.

“We felt that the age of this case was given and the weight of this case, we wanted the community to speak and we wanted the community to hope to repeat it,” said Gerhard, according to Vtdigger.
