A lawyer for suspect in controversial cases of murder of Scotsdale to review Scotus – 12News.com KPNX

The Phoenix-Respondent in Scotsdale’s murder case in Scotfdale is trying to get the US Supreme Court to review his controversial case, according to his lawyer.

Ian Mitham has accused of Alison Feldman’s murder of 2018. Feldman has been killed at his home in Scottsdale, and her family has been fighting for justice for nearly a decade.

DNA dispute

Police identified Mitham as a suspect in Alison’s murder after a DNA collected from the scene showed a family match of DNA profile in a recording with Mitham’s closed brother. At that time, police learned that Mitham’s blood vial was in the possession of the DUI arrest laws in 2015.

Without receiving a new order, the police in Scottsdale analyzed the blood in the vial and created the DNA profile of Mitham, which investigators say corresponds to the unidentified DNA profile in the case of Feldman.

But in 2022, when the case would go to court, the Mitham Defense team filed a request to discard DNA evidence. They claim that the police in Scottsdale has violated the rights of the fourth Mitham repair by using the old blood sample from a different case, a sample that records show that it was destroyed years earlier.

The judge of the judicial court agreed and threw the key evidence of the state. But the Court of Appeal overturned this decision and earlier this year the case went to the Arizona Supreme Court.

In December, judges with the highest court in the state unanimously found that police in Scottsdale violated the rights of Ian Mitham’s 4th amendment, but still stated that the court court had made a mistake in suppressing the evidence.

During the demand for DNA in 2018, Mitham was faced with DUI allegations that are not related to Feldman’s death. Later, Mitham pleaded guilty in this case in 2022, which would lead to the fact that Mitchum presented a DNA sample, which was introduced in a law enforcement database.

The Arizona Supreme Court eventually ruled that DNA could be introduced into the process.

In early February, Mitham’s lawyer Jeffrey Kirchler told 12news by email that he had applied for the Mitham case to be heard by the United States Supreme Court. It would be from the court to decide whether they were taking the case.

Feldman family is still fighting

Harley Feldman, Alison Feldman’s father, continues to fight for justice not only in the case of his daughter, but also for other cases across the country. He is in the national trustee of the custody of the parents of killed children. He also participated in the Local Chapter in Phoenix. He said he also participated in a similar DNA -related DNA case in New York.

“I learned that helping others help me,” Feldman said in an interview from December 2024, “When I help people, I feel better. I do something for them.”

He said Alison also continues to help people. They have a scholarship in her memory at the University of Arizona, which helps students study abroad. He considers that the decision in the Mitham case is a precedent.

“Although we lost it, she leaves something on this earth,” he said.
