The IHOP Franchisee at College Drive has been tried by the restaurant chain for breaching the contract and a violation of the trademark after claiming to refuse to close the location after the expiration of his franchise agreement.

According to the complaint filed with the Federal Court of Baton Rouge on February 10, the franchising agreement between IHOP and 1930 LLC – the franchisor – profitable on January 30. IHOP is looking for an order that will require 1930 LLC to terminate operations, to free up the premises and to transmit hired equipment, its own materials and objects bearing the trademarks of the restaurant chain. IHOP also strives to reimburse lawyers and other costs related to the implementation of the action.

IHOP and 1930 LLC first concluded their franchising agreement in March 2009.

According to the complaint, the only member of the 1930s is based in the Texas Orion Restaurant Holdings LLC, and the members of the Orion Restaurant Holdings LLC are Louisiana FWC Enterprises Inc. and Texas -based Transouth Hospitality LLC.

Representatives for the 1930 LLC failed to be reached for comment before the afternoon for publication.
