State Washington seeks to expand the definition of “non -compliance” and ban most incompetent – the national review of the law

On January 3, 2025, Washington legislation introduced the HB1155 (The Bill), which, if adopted, will extend the definition of a non -compliance and ban all agreements on incompetent employees.

The bill will also strive to clarify the definition of a “non -refunction agreement” under the Washington Act. On January 13, 2025, the bill was referred to the Committee on Labor Standards and Workplace, where it remains in anticipation.

Washington’s Statute, restricting the use of non -compliance agreements in 2020, and it was amended in important ways last year. This bill proposes more changes.

If adopted, the bill will amend a revised sections of Washington (RCW) 49.62.005 and 49.62.010 to expand in the definition of “Testament for non -compliance” and notes that the provisions that protect employees and independent contractors Should be interpreted liberallyS According to the Bill of Non -compliance, it includes:

  • Each a written or oral agreement, agreement or contractThis prohibits or restricts an employee or independent contractor from participating in a legitimate profession, trade or business of all kinds;
  • Testament, agreement or contract between a contractor and a space for performance or any third parties that plan the contractor for the implementation space. S S This prohibits or prevents the contractor from participating in legal execution;
  • Agreement which directly or indirectly prohibits Acceptance or transaction of a business with a client; and
  • Any provision in an agreement This threatens, requires, requires, or otherwise affects that individual return, payment or loss of any right, benefit or compensation as a result of the individual involved in a legitimate profession, trade or business of any kind.
