Donna Adelson, who will be considered later this month for the murder of law professor Dan Markel, appeared in court on Friday for hearing in the pre-trial proposal.

Leon Circuit judge Stephen Everett heard arguments on a proposal to prevent a key state witness, Tallahasesee Police Department SGT. Chris Corbit, from a certified as an expert witness, which will allow him to offer opinions on the evidence.

The defense, in a proposal, submitted at the end of last month, also requested a PowerPoint presentation on 329 pages for communications between the defendants that the state plans to present Corbs of the Stand to be kept outside the jurors’ room during their possible discussions.

Later in the morning, Everett chaired a closed-door hearing at the chambers, which may have included a sealed proposal submitted on Thursday by defense. The proposal refers to Rob Adelson, one of the three children of the defendant and the witness of the prosecutor’s office.

It is reported that a doctor who is alienated by his family, Rob Adelson was on the list to testify in his brother’s process last year but never took the position. No other information about the proposal or hearing was immediately available.

Dan Rashbaum, a lawyer in Miami, representing Adelson, claims that Coribit, who testified in previous lawsuits against Markel’s murder defendants, did not respond to the statutory order of an expert. He also said that PowerPoint of the state for communications is essentially the state’s final argument. The jurors do not receive copies of those when they resolve the case.

“Our argument is # 1, he is not an expert and # 2, the actual exhibit is not a suitable exhibit that would return to jurors during the discussions,” Rashbaum said.

But assistant prosecutor Sarah Catherine Duhan said it would be useful for the jury to hear the specialized knowledge of Corbit, including opinions about who communicates with whom.

“They don’t want him to offer an opinion,” Dugan said.

Everett decided that Corbit would be allowed to interpret the records beyond the very location of the cell towers or what the phone records show.

“This would go into a scientific or technical expertise in which he is able to give an opinion properly,” Everett said.

However, Everett said he would have to hear from Corbit himself how he put the PowerPoint presentation and how his opinions were formed by evidence within the summary.

“Otherwise, I agree with the position of defense,” Everett said. “This is correct and demonstrative, but in order to admit it as proof, I will have to hear more.”

The judge advises Adelson that the window for a legal basis is closing

At the end of the hearing at Courtroom 3G Everett told Adelson that he should decide before the jurors would sit down whether he could take advantage of the case. He added that he did not “give” defendants in one way or another for legal grounds.

“However, if you want to consider making a legal basis from the state, the moment comes to make this decision quickly. If you want your advice to provide an offer to the state, time is also approaching. They also do that,” Everett said S

In other developments, Everett rose on Thursday against a defense proprietary to reject the accusation against Adelson or the exclusion of certain evidence due to preference.

74-year-old Adelson has been accused of first-degree murder, conspiracy and requesting Markel’s death in 2014, her former son-in-law. He was shot at Point Blank Range in his Betton Hills garage by two struck men around at the same time, he and his ex -wife, Wendy Adelson, Donna Adelson’s daughter, broke out in court because of the custody of his two sons.

Adelson is the fifth man accused of the notorious hiring murder after his son’s sentence, Charlie Addelon, last year, both struck men and one of their girlfriends before. She was arrested last November, a week after her son’s sentence as she tried to get a flight to Miami with a ticket to Vietnam.

The selection of a jury in the process of Donna Adelson begins on September 17 at the County of the Leon County.
