A doctor in New York is faced with penalty accusations in Louisiana after prosecutors claim to have prescribed an abortion medicine that ended the pregnancy of the port.

West Baton Rouge parish prosecutor Tony Clayton says it’s illegal to send abortion pills to this country.

“There is a Book Law that every person who distributes, supplies or produces pills that cause and cause abortion, than that person is a principle of violating the law committing the abortion act,” said Clayton.

West Baton Rouge’s big jury has charged Dr. Margaret Carpenter and a 39-year-old mother who supposedly gave her daughter’s pills a teenager.

Most abortions are illegal in Louisiana, as the US Supreme Court overturned Rowe against Wade in the summer of 2022. Clayton says this includes abortion drugs.

“Abortions are illegal (in Louisiana) and in order to put a pill in the trade that eventually enters the mouth and stomach of a child, I believe some people should answer it,” said Clayton.

Clayton says he doesn’t pursue the minor who has been taking drugs. He says last April her mother instructed her daughter to take the pills that were sent by the new Paltz clinic in New York. Dr. Carpenter has been practicing family medicine for more than 20 years.

Clayton says this is the first criminal accusation of his kind in Louisiana.

“The state votes that abortions are illegal, so you can’t hide behind New York voters and the ship’s pills here to have abortions here in Louisiana,” Clayton said.

However, New York has passed a law that protects doctors from abortion. New York Governor Katie Hochul says he won’t extradite D -Crpenter to Louisiana.

But the challenge of Governor Hochul can eventually be a show.

According to Professor of Lion’s Lawlast Dane Siline, extradition can be inevitable.

“The United States Constitution has an extradition clause that usually requires NY to be extradited,” Silio said in an email to WWL First News. “If New York refuses, Louisiana can go to the federal court to get Mandamus to force her to extradite.”

But the extradition clause of the Constitution, the Ciolino points out, requires the defendant to be a “fugitive”. As D -R Carpenter is not present in Louisiana for the alleged crime, New York Governor may not have a legal obligation to extradite her.

If Carpenter and the 39-year-old mother are sentenced, they are in prison for up to five years.
